Public Hearing has been set for June 2, 2015.

PZC2015-17 Application for Modification to existing approved special permit and site plan at 350 Ruby Road and 328 Ruby Road Owners: FedEx Ground Package Systems, Inc and Ruby Associates General Partnership (Received April 7, 2015 Public Hearing June 2, 2015 ~decision within 65 days after close of P.H.)

Old Business

PZC2015-10 Amend Zoning Regulation Section 5.02.01.02 to add Section 5.02.01.02.20 ~~Keeping of pleasure horse(s), including a building to house, exercise and train the pleasure horse(s). Notwithstanding the provisions ~of Section 7.01.03 and Table 7.1 of these regulations, on a parcel containing at least four (4) acres in accordance with Section 4.04.01 of these regulations, the Commission may grant a special permit for an accessory indoor equestrian riding building and outdoor equestrian riding area not open to the general public, for the exclusive personal use of the occupants of the property, their family and friends, who must not be required or allowed to pay any fee, provided that the size of the accessory indoor equestrian riding building does not exceed the gross area of the existing dwelling on the property by three hundred percent (300%). Applicant: Earl O. and Michele A. Bancroft (Received March 3, 2015 Public Hearing May 5, 2015 Decision within 65 days after close of P.H.)

The public hearing was closed May 5, 2015.  A. Marco previously listened to the recordings from the public hearing.  He said Atty. Jacobs introduced prior conversations and it was decided they would enter this information into this public hearing.

Discussion was held on the wording “friends” in the application.  A discussion was held on the sq. footage of the equestrian building based on the square footage of the existing dwelling.  Discussion was held on impervious surfaces.  E. Standish said his concern is on applications that may come in the future.  S. Yorgensen read the minimum building requirement.  

Further discussion was held on the wording “exclusive personal use of the occupants of the property, their family and friends”.  D. Roberts said Atty. Branse suggested taking the word “friends” out and a discussion was held on the attorney’s recommendations.  D. Roberts asked if neighbors could sue the town if the commission made the regulation less restrictive.  S. Yorgensen said they could if they thought it was de-valuing their property.  

Further discussion was held on the size of the riding building.  

W. Parsell motioned to amend Zoning Regulation Section 5.02.01.02 to add Section 5.02.01.02.20 ~~Keeping of pleasure horse(s), including a building to house, exercise and train the pleasure horse(s). Notwithstanding the provisions ~of Section 7.01.03 and Table 7.1 of these regulations, on a parcel containing at least four (4) acres in accordance with Section 4.04.01 of these regulations, the Commission may grant a special permit for an accessory indoor equestrian riding building and outdoor equestrian riding area not open to the general public, for the exclusive personal use of the occupants of the property and  their family who must not be required or allowed to pay any fee, provided that the size of the accessory indoor equestrian riding building does not exceed the gross area of the existing dwelling on the property by no more than three hundred percent (300%) and in no case should the building exceed 8,000 square feet. D. Roberts seconded the motion.  

A discussion was held on an effective date.  The effective date was set for June 15, 2015.  A vote was held.  All in favor.  Motion carried.

E. Standish motioned to approve the minute of May 5, 2015.  P. Nevers seconded the motion.  All in favor.  Motion carried.
